Terms of service

Welcome to Sahā Quest. These Terms of Service (“Terms”) govern your Membership and participation in trips and experiences with Sahā Quest Inc. (“Sahā Quest,” “we,” “our,” or “us”). By joining as a member or booking a trip, you agree to these Terms.
If you do not agree, you may not purchase a Membership or participate in any Sahā Quest trips or services.
1. Membership Basics
- Membership begins when Sahā Quest accepts your application.
- Membership is valid for one year and automatically renews unless cancelled at least 30 days before renewal.
- You must remain an active, fully paid member both at the time of booking a trip and at the time of travel.
- Memberships are personal, non-transferable, and non-assignable.
2. Membership Fees & Credits
- Membership Fees are due upon acceptance and are strictly non-refundable.
- Promotional credits (if offered) must be used within seven (7) days of your Membership start date and may only be applied toward trip bookings. Credits are non-transferable and expire automatically if unused.
3. Payments & Refunds
- All payments (Membership or trip-related) are non-refundable.
- Trip booking payments:
- Bookings within 90 days of departure → 100% due at booking.
- Bookings more than 90 days out → 50% deposit due at booking; balance due 90 days before departure.
- If the final balance is not received 90 days before departure, your reservation will be cancelled and payments forfeited
- Payments must be made through the official payment link provided by Sahā Quest.
4. Travel Insurance
- You must purchase comprehensive travel insurance covering trip cancellation, interruption, medical emergencies (including evacuation), and baggage loss.
- Proof of insurance must be provided within 48 hours of booking your trip.
- Sahā Quest reserves the right to cancel your booking if adequate proof is not provided.
5. Trips & Inclusions
- Each trip is booked separately from Membership.
- Only items explicitly listed in the itinerary are included (accommodations, certain meals, and activities as specified).
- Flights, visas, insurance, tips, and personal expenses are not included unless stated otherwise.
- Airport transfers are provided only from international airports within 100 miles of the trip’s arrival/departure city.
6. Member Conduct & Safety
- Members must behave respectfully toward fellow travelers, Sahā Quest staff, and suppliers.
- Harassment, discrimination, disruptive or unsafe behavior (including excessive intoxication) will result in immediate removal without refund.
- Sahā Quest may decline participation if, in its sole discretion, a traveler is deemed medically, physically, or otherwise unfit to travel.
- Travelers are responsible for disclosing any medical conditions, mobility limitations, or special requirements prior to booking. Sahā Quest cannot guarantee that all accommodations will be met.
7. Suppliers & Third Parties
- Many services (transport, tours, accommodations, activities) are provided by independent third-party suppliers (“Suppliers”).
- Sahā Quest is not responsible for the performance, accuracy, or policies of Suppliers.
- All services are subject to Supplier terms and conditions, which apply in addition to these Terms.
8. Liability & Risk
- Travel involves risks, including illness, injury, or events beyond our control. By joining Sahā Quest, you accept these risks.
- Sahā Quest is not liable for any losses, injuries, damages, delays, or expenses arising from:
- Supplier actions or failures,
- Force majeure events (including pandemics, weather, strikes, natural disasters, terrorism, etc.), or
- Your own actions or failure to follow instructions.
- Our liability, if any, is limited to the amount you have paid us in the 12 months prior to a claim.
9. Privacy, Media & Intellectual Property
- By traveling with Sahā Quest, you consent to the use of your likeness (photos, video) in promotional materials without compensation.
- Your personal information is handled in accordance with our Privacy Policy (available on our website).
- All Sahā Quest branding, itineraries, and materials are our intellectual property. Members may not copy, use, or distribute them without prior written consent.
10. Dispute Resolution & Governing Law
- These Terms are governed by the laws of the State of New York.
- Any disputes will be resolved by binding arbitration in New York under AAA consumer arbitration rules.
- You waive the right to participate in class actions or representative proceedings.
11. California Seller of Travel Registration
Sahā Quest Incorporated is a registrant of the California Seller of Travel program, registration number 2162040-40, valid until November 17, 2026.
Registration as a seller of travel in California does not constitute the state’s approval. The program requires that passenger deposits be maintained in a trust account, which Sahā Quest maintains.
The purchase of travel services from Sahā Quest is covered by the California Travel Consumer Restitution Fund (TCRF) if:
- Sahā Quest was registered and participating in the TCRF at the time of sale, and
- The passenger is located in California at the time of payment.
Passengers outside of California are not covered by the TCRF.
